Christopher Pennington Legal 225 (MWF 11:00- 11:50) 2/1/17 Chatper 1 Case Question 1; P. 18 You be the Judge Chapter 1 Case Question 1 If a civil case was brought to the court regarding Bob burglarizing Vince's house, the state may prosecute Bob solely of the crime. Vince can also file a civil lawsuit in regards to suing Bob for negligence and for destroying his possessions, seeking money. In this instance criminal and civil law are joined together. If a criminal case was brought to the court regarding Bob burglarizing Vince's house, it would be prosecuted by the government who pays a district attorney to bring it to the courts. A criminal case is solely in the governments hands and not Vince's. In a criminal case if the jury was to believe that Bob was guilty of burglarizing Vince's house, he would be subject to a punishment of a prison sentence, fine, or both. If fined the money goes to the state, not the opposing party. P. 18 You be the Judge I believe that the Plaintiff Soldano is not justifiable in regards to filing a civil suit against the defendant, the owner at the Circle Inn. I say this because the fight did not break out on the Circle Inn's property, the property also happens to be private. This leaves the plaintiff out of favor because the fight was not held there and the bartender from the Circle Inn was working in his private area, which gave him no accessible liability to anything happening across the street. I would personally rule in favor for the plaintiff against the defendant's argument.
